Fenomen Mükremin'e Gezgin was acquitted of the crime of 'obscenity'

The Ministry of Family and Social Services filed a criminal complaint against celebrity Mükremin Gezgin, charging her with "indecent acts" and "obscenity" after she shared images on her social media accounts of herself asking boys, "Am I a woman?" Gezgin was taken into custody in Ankara as part of an investigation launched by the Ankara Chief Public Prosecutor's Office. In April, a judge sentenced her to house arrest for "obscenity."
'MAY HAVE A NEGATIVE IMPACT ON CHILDREN'
The indictment prepared by the Ankara Chief Public Prosecutor's Office stated that an investigation was conducted following a criminal complaint filed by the Ministry of Family and Social Services. It was stated that Gezgin posted a video on the social media platform Instagram account titled "@mukremingezgin." The video contained obscene language, and that the dissemination of these images could have a negative impact on children. The indictment noted that upon examination, the bottom of the vest, tied at the waist, was pulled up, exposing her hips, and she was walking with her hips swaying. It was also stated that she was uttering some words to those around her, children's voices could be heard, and that she told the children, "Calm down, honey," and placed her hand on their shoulders, saying things like, "I'm a woman, aren't I? I'm a woman, I'm a woman."
3-YEAR PRISON REQUEST
In his defense statement included in the indictment, Gezgin stated that his followers frequently asked, "Are you a woman?", which is why he made videos asking, "Am I a woman?" He stated that his hip area was unintentionally shaking due to the clothing he was wearing on the day of the incident. He stated that he had tied his vest before encountering the children before the video and that the content did not contain any sexual innuendos towards children. He stated that there was no intention of obscenity in the videos and that he would be more careful in content featuring children from now on. It was reported that Gezgin had designed his clothing and walk to emphasize his hip area and that he shared these images on social media in a planned manner. It was stated that there was sufficient evidence to file a public prosecution against him for "facilitating the publication of obscene publications." The indictment requested a prison sentence of up to three years for the defendant.
'THEIR ACTIONS ARE ARTISTIC'
Defendant Mükremin Gezgin and his lawyer, Elif Narin Dursun, were present at the first hearing of the case filed at the Ankara 42nd Criminal Court of First Instance. In his defense, attorney Dursun stated, "My client was filming a video at the market that day, and children spontaneously joined in. He shares the video in places like the market, the street, and his home. The video in question does not violate public morality, nor does it contain sexual content. In fact, my client's actions are artistic. My client is being ironic, and citizens are laughing at it. This is a comedy. We must evaluate it as we have seen before in Huysuz Virjin. As stated in Supreme Court decisions, mere openness is not enough; this behavior must be sexually motivated. Therefore, we request an acquittal."
THE CRIME HAS NO LEGAL LIMITS
The prosecutor stated in his opinion that the legal elements of the crime were not met and requested acquittal. Defendant Mükremin Gezgin stated, "I accept the opinion. I feel like a woman, and I feel good when I say this. I say 'I am a woman' in the footage and throughout the video. There is no video specifically shot on the day of the incident. The clothes I am wearing are the clothes I always wear. I request acquittal." The court acquitted Mükremin Gezgin on the grounds that the legal elements of the crime in question were not met.
